General Terms

• The graphics that make up the layout of this site are in no way permitted for use, aside from your viewing pleasure as seen from my server =)
• The text content of this website is also copyrighted and is in no way permitted for use without express written permission from me - Amanda.
• HeartsEnchanted.com is not in anyway affiliated with any other HeartsEnchanted."insert domain suffix" (i.e. .net, .org etc..) Any HeartsEnchanted website aside from the .com portraying itself as a pixel/graphics entity is merely a sad imitation. The same applies to FaeryInk.com and TripleMoon.org. HeartsEnchanted.com , FaeryInk.com and TripleMoon.org are the original, Amanda owned and operated. Any other extensions are not affiliated.
• Anything purchased or downloaded from HeartsEnchanted.com MUST be accompanied by a clear comprehendible credit linked to http://www.heartsenchanted.com . A "credits page" will -NOT- suffice. It's very rude to just toss a page of links together and call that credit to the artists behind all the graphic goodies you use. Be respectful, make sure people know who made the things you use with a clearly defined credit linked to the artists website. You may not think anyone notices but believe me - they do, and will judge you by how carelessly you treat your "favorite" original artists.
• Please keep in mind that I retain the copyright to all of my creations. If I am unhappy with how you are using the items I offer here (whether or not I have expressly mentioned it in this Terms of Use) I have the right to ask you to stop, remedy the situation or remove whatever it is that I feel is being misused from your site altogether - without refund. So, please do not bother looking for loopholes. Ask any honest customer I've dealt with and they will tell you I am pleasant and fair in all of my interactions - please don't make me be unpleasant.
• PLEASE NOTE: The whole of these Terms of Use ALSO apply to the items available in the members area!

Linkware

• The linkware dolls available from HeartsEnchanted.com are available to be used "as is" only unless express written permission is obtained from me - Amanda.
• The linkware bases available from HeartsEnchanted.com are available to be used to create your own dolls for personal, non-commercial use only. If you would like to use these bases for commercial purposes please contact me for a tubing/commercial license fee on a per linkware base set basis.
• The linkware websets and the websets, update boxes, background tiles, calendars, cursors, beatnik skins, and smilies available in The Faery Ink Archive ARE NOT to be redistributed OR edited in any way with the exception of blank "header", "signature" and "link logo" graphics to which you may add your site title and or name.
• The linkware websets, dolls, the dolls you create from the linkware bases and all of the graphic items available from Hearts Enchanted, MUST be accompanied by a clear comprehendible credit linked to http://www.heartsenchanted.com. A credits page truly will not suffice. The websets available in the linkware section come with a matching credit link/link logo which MAY NOT be removed or altered in anyway (except to change the link from http://www.faeryink.com or http://www.faeryink.net to http://www.heartsenchanted.com )

Signatures

• The signatures found under the Category: Purchaseware are available for purchase and permitted for use after payment has been made (and cleared if paying by e-check or money order)
• The signatures found under the Category: Purchaseware are not permitted for editing in any way. If, for instance, you change your hair color or your net alias and want a new version of the signature with your new hair color or net alias, you will have to buy a new signature. You are not permitted to open the signature in a graphics program of any sort.
• The signatures found under the Category: Purchaseware are not permitted for use in "snag" groups or forum or any other group/forum that promotes or permits the sharing of copyrighted images illegally.
• Unless clearly and specifically stated otherwise, you do not have permission to distribute the signatures in any way. Even if your dear best friend should happen to have the same name, hair color, skin tone, eye color and favorite dress color =OP
• The signatures you purchase from this website may be used ONLY in the following ways:
  As your signature at your favorite forum (with a clear and comprehendable link and credit accompanying it)
  As your signature in your emails (again, with a clear and comprehendable link and credit accompanying it)
  On display at your website with a clear and comprehendable link and credit accompanying it.

Tubes

• The tubes available for purchase from Hearts Enchanted or available in the members area are not permitted for resale "as is" without express written permission from me - Amanda, which is not likely to be granted.
• The tubes available for purchase from Hearts Enchanted or available in the members area are NOT permitted to be "re"tubed for distribution unless express written permission is obtained from me - Amanda.
• The tubes avaiable for purchase from Hearts Enchanted which are indicated as available for tubing (as stated on the SAME page and in the SAME area the tubes are offered from) must be fully edited. In the case of the doll tubes, they must be completely clothed in more than a bikini or cat suit and with hair.The most crucial aspect here is that what you give/sell as tubes MUST be blatantly unique to you!!!!
• The tubes available in the Hearts Enchanted members area are available for tubing provided a tube license is purchased per set you would like to re-tube. As wtih all the other tubes permitted for re-tubing, these tubes must be clearly edited, recompiled and added to in order to create something uniquely yours.The most crucial aspect here is that what you give/sell as tubes MUST be blatantly unique to you!!!!
• The accessories in the base sets are only permitted for use with bases from Hearts Enchanted! The hair, clothing, wings, pets etc... can only be used with the Hearts Enchanted bases. Backgrounds included in the base sets however can be used with any bases you feel fitting.
• The tubes purchased from Hearts Enchanted are permitted for editing as such: recoloring, adding to other items to create a more complex image.
• Any graphics, stationeries or other objects utilizing tubes purchased from Hearts Enchanted MUST be accompanied by clear comprehendible credit and link to http://www.heartsenchanted.com where displayed and distributed. A "Memberships" or "Credits" or "Licenses" or "Links" page WILL NOT SUFFICE!!! Credit AND Link on the same page in a manner which clearly defines which tubes in the creation were purchased from Hearts Enchanted!!!!!

Line Art

• The line art available for purchase from Hearts Enchanted is not permitted for resale "as is" without express written permission from me - Amanda, which is not likely to be granted. This also applies to Line Art available in the members area.
• The line arts available for purchase are permitted to be tubed for distribution provided they are colored in at least 4 different colors including shadow and highlights and edited into a unique creation individual to the person who purchased the line art from Hearts Enchanted. This also applies to the line arts available in the members area.
• Any tubes, graphics, stationeries or other objects utilizing line arts purchased from Hearts Enchanted or available in the Faery Ink Archive, MUST be accompanied by clear comprehendible credit and link to http://www.heartsenchanted.com where displayed and distributed. A "Memberships" or "Credits" or "Licenses" or "Links" page WILL NOT SUFFICE!!! Credit AND Link on the same page in a manner which clearly defines which lines in the creation were purchased from Hearts Enchanted!!!!!

Incredimail Letters

• The Incredimail Letters whether purchased or free downloadable, are not permitted for distribution in any way.
• The graphics that make up the layout of the Incredimail Letters whether purchased or free downloadable, are not permitted for editing or distribution in any way.
• The Incredimail Letters are not permitted to be taken apart and rearranged or otherwise dismantled or edited in any way. Copyright/credit and links must remain intact.
• The Incredimail Letters whether purchased or free downloadable are not permitted for use in "snag" groups or any other groups that promote or permit the illegal distribution of copyrighted materials.

Customs

• Most custom orders come with their own unique set of terms as some permissions can be purchased at an additional fee.
• Custom orders may not be redistributed unless that option was included in your custom package.
• All custom orders if displayed or distributed MUST be accompanied by a clear comprehendible credit linked to http://www.heartsenchanted.com.
• Once your custom order is delivered in full, NO refund will be given
• With some exceptions, custom orders will not be delivered until payment in full has been completed.

• The tutorials available at HeartsEnchanted.com are not to be distributed in any way. They are the copyrighted works of me - Amanda.
• You are permitted to link to the tutorials as part of challenges or events for your e-group or forum provided the e-group or forum is a not-for-profit establishment.
• Your tutorial results should be a unique creation individual to you and should not look exactly like mine (or anyone else's for that matter)
• If line art is provided for the tutorial then your tutorial result CANNOT be used for profit in any way.

Membership

• You are not permitted to share your login information with anyone, at anytime, for any reason, aside from myself - Amanda. Doing so will revoke your membership as well as any licenses you may have purchased.
• You are required to use the items available in the members area under the same conditions outlined in the Terms of Use for the public area of the website.
• Please write down your login information as I will only send it to you three times per 3 month membership period. If you lose it after using those three password requests than you are unfortunately out of luck :( Sorry!
